The Executive Schedule [5 U.S.C. § 5311 - 5318] describes the calculation method of the basic pay rates for federal government positions other than Senior Executive Service positions, and positions within the Federal Bureau of Investigation(FBI) and Drug Enforcement Agency(DEA) Senior Executive Services. The code also categorically lists those positions in accordance to the levels of those rates.

Determination of Rate

5 U.S.C. § 5318 denotes that starting at the beginning of the first pay period for any position under the Executive Schedule, the amount of pay will be adjusted and rounded to the nearest multiple of US $100. If this amount is found to midway between multiples of US $100, then it will be rounded to the next highest multiple of US $100.

Rates of Pay

The United States Office of Personnel Management(OPM) manages the civil service resources of the Federal Government. It also establishes the pay rates[1] for the Executive Schedule as well as the Senior Exective Service. The following are the rates of pay as of 2007 for Levels I-V of the Exective Schedule:

  • Level I: US $186,600
  • Level II: US $168,000
  • Level III: US $154,600
  • Level IV: US $145,400
  • Level V: US $136,200

Additionally, the rates of basic pay for the SES are:

  • For Agencies with a certified SES Performance Appraisal System
    • Minimum: US $111,676
    • Maximum: US $168,000
  • For Agencies without a certified SES Performance Appraisal System
    • Minimum: US $111,676
    • Maximum: US $154,600

Executive Privilege

5 U.S.C. § 5317 allows the President at any time to appoint not more than 34 individuals to pay rates Level IV and V, provided that they are viewed as a necessary change to organization, management responsibility, or workload within a specific agency. However, senate consent is required and the pay rate takes effect only upon a new appointment to that position. All actions taken during this process are to be published in the Federal Register, except when it is deemed that such publication would stand in conflict to National Security.
